These Terms of Use govern Skillberry Visuals mobile and web apps, the Skillberry website, and related account, cloud, community, Team and Family services provided by Renee Gomez (“Skillberry,” “we,” “us,” or “our”). By accessing or using these services, you agree to these Terms. If you do not agree, do not use them.
Skillberry AAC is in development. Joining its website interest list requests product updates; it does not create an app account, purchase a service or guarantee access or a launch date. Any future AAC app or test program will identify the terms and notices that apply when it becomes available.
Skillberry Visuals provides tools such as token boards, schedules, First Then boards, choices, task visuals, timers, custom media and routines. Accounts, purchasing, management and sharing are intended to be handled by adults. Children and learners may use prepared visuals with appropriate supervision.
Use Skillberry lawfully and within the access granted to you. You are responsible for choosing suitable content, obtaining any needed permissions and supervising use. Features and access depend on your plan, device, app version and connectivity; confirm the current description before purchasing.
You remain responsible for the names, text, images, recordings, templates, visuals and other material you create, upload or share (“User Content”). You must own that material or have permission to use it, including any consent needed for another person’s image, voice or information.
You grant us the permission needed to store, process, synchronize and display your User Content to provide the features you select. If you submit content to a community or Team library, that permission includes reviewing it and making it available to the audience you choose; recipients may save permitted copies for use in Skillberry.
Community submissions are subject to moderation. Do not publish identifiable learner information, private recordings, unlawful content or material that violates another person’s rights. A submission may include its images and sounds; a template’s creator display name may be shown publicly. We may reject, remove or restrict content that violates these Terms or threatens the service.
Removing an original or withdrawing a published item does not recall copies other users already saved, printed or downloaded, or remove included audio from their saved templates.
Skillberry’s software, original design and other developer-owned materials belong to Renee Gomez or the relevant licensors and are protected by applicable law. Third-party and user materials remain subject to their owners’ rights.
We grant you a limited right to use the service for its intended purposes within your plan and these Terms. Do not copy, redistribute, modify or extract the software, or reverse engineer it, except with permission or to the extent applicable law allows. This does not restrict the app’s provided export/print features for content you are authorized to use.
Do not use Skillberry for unlawful, exploitative, abusive, fraudulent or discriminatory activity; upload malicious code; infringe privacy or intellectual-property rights; misrepresent another person; bypass access/device limits; share account credentials to evade a plan; or interfere with the service, moderation or security.
Do not submit sensitive learner information to public libraries or use Skillberry as a clinical-record repository. We may limit, suspend or terminate access, or remove content, when reasonably necessary to address a violation, protect users or comply with law.
Skillberry offers visual-support and communication-related tools. It does not provide medical, psychological, diagnostic or therapeutic advice and does not guarantee a behavioral, educational or communication outcome.
Use qualified professional advice when needed and adapt tools to the person’s needs and preferences. Skillberry is not an emergency service or a substitute for professional care.
To the fullest extent permitted by applicable law, the services are provided “as is” and “as available,” without additional express or implied warranties. We do not guarantee uninterrupted or error-free operation, identical features across devices, immediate synchronization, permanent availability of community content, or that data will never be lost.
Maintain appropriate copies of important content. Offline/local storage, network interruptions, browser-storage clearing and third-party service outages can affect availability. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
To the fullest extent permitted by law, Renee Gomez and Skillberry are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, revenue, data or goodwill, arising from use of or inability to use the service, device/connectivity problems, unauthorized access, misuse, or interruption/discontinuation.
To the fullest extent permitted by law, our total liability for a claim relating to the service will not exceed the amount you paid for use of the service in the twelve months before the event giving rise to the claim. These limits do not exclude liability or remedies that applicable law does not allow us to limit.
Skillberry may offer free access, Clubhouse subscriptions and organization/Team access. The offer or checkout shows the current price, billing interval, features, taxes where applicable and renewal terms. Organization access may also be subject to a separate agreement; a separate agreement governs where it expressly changes these Terms.
The in-app Clubhouse access trial gives eligible signed-in accounts a one-time 7-day trial without a payment requirement or automatic charge. Purchasing a subscription is a separate action. For any paid subscription or other trial offered through checkout, review that offer’s charge and renewal terms before accepting it.
Subscriptions may renew automatically according to the terms shown at purchase until canceled. Manage purchases, cancellation, restoration and refund requests through the relevant Apple, Google or web billing service. Refund eligibility and any continuing access depend on that provider’s terms and applicable law.
Uninstalling, signing out or deleting a Skillberry account does not cancel billing. Store and payment-platform terms also apply to the transaction. Changes to paid offers will be handled with the notice or consent required by applicable law.
We may revise these Terms as the service changes. Revised terms will be posted with an updated date, with additional notice where appropriate or required by law. Changes take effect as described in the notice; where consent is required, we will request it. If you do not agree to applicable revised terms, stop using the affected service.
Some features work in guest mode; others require an account or eligible plan. Keep account details accurate and credentials secure. Signing in can synchronize saved content, custom media, profiles and activity history. Synchronization is not guaranteed to be instant or simultaneous, and local-only content may be lost when an app is removed or browser storage is cleared.
Team administrators and authorized staff are responsible for their organization’s invitations, member roles, learner records, approvals, sharing grants and lawful use of learner information. Family Access connects specific accounts and learners; visual access and activity-summary access can be controlled separately.
Approved reusable Team Library items are available to authorized Team members. Assigning an item to one learner does not make it private to that learner. Review your audience and permissions before contributing personal or learner-specific material.
Revocation or removal stops future authorized access as clients reconnect, but cannot recall independent copies, downloads or exports. Do not promise recipients that a source deletion will remove every copy.
Signed-in users can request account deletion through the app. Leave Team membership first; ask your administrator or contact us if you need help. Deletion removes the account and owner-controlled cloud data through the deletion service, subject to the retention and shared-copy limits in our Privacy Policy.
Uninstalling does not delete the cloud account. Source profile or learner deletion does not automatically delete independent Team Library items or recipient copies. Deletion also does not cancel a paid subscription; cancel through the purchase provider separately.
Skillberry relies on providers for authentication, cloud storage, sign-in, billing, website hosting, email and other functions. These include the providers identified in our Privacy Policy. Their terms apply when you use their services directly, and their availability can affect Skillberry.
We are not responsible for third-party policies or services beyond our legal obligations. Follow the purchase or sign-in provider’s instructions when managing an account, payment or subscription with that provider.
These Terms are governed by the laws of Texas, United States, subject to any mandatory rights or consumer protections that apply where you live. If a provision is unenforceable, the remaining provisions continue to apply.
You may stop using Skillberry at any time. We may suspend, restrict or terminate access when reasonably necessary because of a breach, misuse, security/abuse risk, legal obligation or discontinuation of a service. Termination does not itself cancel a subscription or erase copies already shared; the billing and deletion provisions above still apply.
Our Privacy Policy describes information collection, account-linked analytics, local/cloud storage, community/Team/Family sharing, retention and deletion. Please review it before entering another person’s information or using sharing features.
